  • South Carolina Revises Regulations Governing Group Capital Calculations
    The South Carolina Department of Insurance (Department) has revised the regulations governing insurance holding company systems in order to harmonize such regulations with standards established by the National Association of Insurance Commissioners (NAIC). The revised rule was adopted and effective May 23, 2025.

  • Michigan Provides Guidance on Use of Aerial Images
    The Michigan Department of Insurance and Financial Services has issued Bulletin 2025-12-INS, which reminds homeowners insurers of the legal restrictions on their use of aerial imagery to assess property conditions. The bulletin was issued and effective June 6, 2025.

  • Louisiana Ends Fraud Account Refunds to Insurers
    Louisiana House Bill 401 will require unexpended and unencumbered funds collected through the special assessment fraud fee on insurers to remain in the Insurance Fraud Investigation Dedicated Fund Account instead of being refunded to insurers at the end of the fiscal year. H-401 also repeals language describing a fee adjustment mechanism for insurance fraud prevention funding. H-401 became effective immediately upon the governor's approval on June 4, 2025.

  • Michigan Revise Rules Governing Workers' Compensation Health Care
    The Michigan Workers’ Disability Compensation Agency has revised rules governing Workers’ Compensation Health Care Services, including procedural codes, modifier codes and source documents used for billing by health care providers. The revisions were adopted and effective June 4, 2025.

  • Colorado Classifies Each Careless Driving Injury as a Separate Offense
    On June 2, 2025, Colorado enacted Senate Bill 281, which increases penalties under the state's careless driving law. The bill clarifies that if a person’s actions are the proximate cause of serious bodily injury or death to multiple individuals, each injured or deceased person is treated as a separate violation, and the offender commits a class 1 misdemeanor traffic offense for each violation. The bill became effective upon enactment.

  • Utah Enacts App Store Accountability Act
    Utah Senate Bill 142, the App Store Accountability Act, establishes new consumer protection requirements for app store providers, prohibits app stores from enforcing contracts with minors without parental consent, and classifies violations as deceptive trade practices. It also directs the Division of Consumer Protection to set age verification standards and creates a private right of action for users affected by violations. The bill has multiple effective dates.

  • California BAR Adopts Final Rule on Tear Down Requirements
    The California Bureau of Automotive Repair ("BAR") has adopted a final rule, which amends tear down disclosure regulations for automotive repair dealers to further specify estimate requirements related to the repair of a vehicle and payment by third-party vendors. The rule becomes effective on July 1, 2025.

  • Oregon Issues Bulletin 1 Regarding Maximum Attorneys' Fee Awards
    Oregon has issued Bulletin 1 regarding maximum attorneys' fee awards. These adjusted maximum fees apply to attorney fees awarded by orders issued on July 1, 2025, through June 30, 2026, and to a claimant’s attorney's time spent during a personal or telephonic interview or deposition between July 1, 2025, and June 30, 2026.

  • Nevada Enacts SB-166, Restrictions Against Dog Breeds and Housing
    Nevada has nacted Chapter 173 of the laws of 2025 (SB-166), which prohibits insurers from discriminating based on the breed of a dog at certain residential properties. The law was approved by the governor on May 31, 2025, and becomes effective on October 1, 2025.

  • Massachusetts Provides Guidance on Mandatory Flood Exclusion Disclosures
    The Massachusetts Division of Insurance (Division) has provided guidance on submitting the newly required disclosure regarding flood coverage. Effective for all policies issued or renewing January 1, 2026, carriers are to submit for the Division’s review a separate disclosure notice clearly identifying that the home or dwelling insurance policy does not cover loss from flooding. The Division expects all disclosures to be submitted by September 1, 2025, via SERFF.

  • New York Proposes Mandating Electronic Filing of Specific Documents with the NAIC
    The New York Department of Financial Services (DFS) has proposed amending 11 NYCRR 6.2 (Regulation 95), Electronic Filings and Submissions. The proposed amendments would require electronic submission of certain documents to the NAIC. APCIA will be collecting member comments until July 27, 2025.

  • New Hampshire Issues Bulletin Regarding NPN Overrides and Producers of Records
    The New Hampshire Insurance Department (NHID) has issued a bulletin regarding national producer number (NPN) “overrides” and producers of records. Signing an insurance application as “producer of record” when said producer has no knowledge of or has had no interaction with the consumer is a violation of NH law. Additionally, utilizing the NPN override function to submit an application under the NPN of another producer also violates NH law. Violations may result in administrative penalties including fines and licenses suspension revocation. This applies to the producer writing any lines of business in New Hampshire.

  • New York DFS Issues Disaster Preparedness Circular Letter
    New York’s Department of Financial Services (DFS) has issued Insurance Circular Letter No. 3. This circular letter sets forth the standards expected of insurers in planning, preparing for, and responding to disasters. In order for DFS to know which insurer to contact in the event of a disaster, certain insurers must submit a response to DFS’s pre-disaster data survey by June 27, 2025. By August 15, 2025, all insurer must submit a disaster response plan, a response to the disaster response plan questionnaire, and a response to the business continuity plan questionnaire. This circular letter replaces Circular Letter No. 4 (2024).

    Tennessee enacted Senate Bill 280, which provides civil immunity to law enforcement officers who cause property damage or personal injury while performing their official duties, if the injured person was convicted of certain offenses. Tennessee Senate Bill 280 took effect on April 11, 2025.

  • Utah Makes Various Changes to Workers' Compensation Law
    Utah Senate Bill 190 expands the Labor Commission's authority to disclosures by health care providers; expands the Labor Commission's authority over fees for health care providers; and expands the prohibition of balance billing for workers' compensation claims to health care providers. Utah Senate Bill 190 took effect May 7, 2025.

  • Colorado Narrows Physician Definition for Workers’ Compensation Accreditation Eligibility
    On May 29, 2025, Colorado enacted Senate Bill 186, overhauling the state’s workers’ compensation accreditation system. The bill restricts Level I and II “physician” accreditation to those licensed under the Colorado Medical Practice Act, excluding dentists, podiatrists, and chiropractors, and clarifies that licensure alone does not confer accreditation. Colorado Senate Bill 186 takes effect on August 6, 2025.

  • Colorado Enacts New Law Requiring Timely Certified Policy Delivery
    On June 3, 2025, Colorado enacted House Bill 1322, which requires homeowner insurers to provide a certified copy of the policy within 30 days of receiving a written request submitted through the carrier’s registered agent. Failure to comply triggers a daily $50 penalty starting on day 31, and insurers may also be liable for the policyholder’s attorney fees and enforcement costs. The law takes effect August 6, 2025, and applies to requests made on or after that date.

  • Colorado Regulates Third Party Litigation Funding
    On June 3, 2025, Colorado enacted House Bill 1329 regulating foreign third-party litigation funding in civil cases. The law establishes disclosure requirements for foreign funders with a financial interest in litigation and imposes restrictions on their conduct, including prohibitions against using domestic entities to provide funding, influencing legal strategy or settlements, claiming profits beyond agreed terms, or sharing sensitive or proprietary information. Colorado House Bill 1329 takes effect on August 6, 2025.

  • Nevada Enacts AB-466 on Portable Electronics and Notice Requirements
    Nevada has enacted Chapter 172 of the laws of 2025 (AB-466) regarding portable electronics insurance and certain notice requirements imposed on an insurer that issues a policy of portable electronics insurance. The law was approved by the governor on May 31, 2025, and becomes effective on October 1, 2025.

    The Colorado Division of Insurance has proposed repealing one regulation and two bulletins related to requests for commercial or personal automobile policy information under § 10-3-1117, C.R.S., as the guidance they provide is now considered duplicative and no longer necessary.

  • Nebraska Requires Property Insurance Disclosure in Transfer on Death Deeds
    On May 30, 2025, Nebraska enacted Legislative Bill 422, which clarifies and expands the requirements related to Transfer on Death (TOD) deeds under the Nebraska Uniform Real Property Transfer on Death Act, specifically addressing property insurance implications following the death of the transferor. Nebraska Legislative Bill 422 is effective three months after the adjournment of the legislature.

  • Rhode Island Updates Public Records Regulation to Reference New Online Portal
    The Rhode Island Department of Business Regulation (DBR) has adopted amendments to the Access to Public Records regulation to reference a new online portal for making public records requests. DBR also added a reference to the statutory appeal procedures and removed redundant or outdated information from the regulations. The amendments take effect June 23, 2025.

  • Vermont Amends Various Worker’s Compensation Statutes
    On May 28, 2025, the governor of Vermont signed SB 117. The bill, among other things, establishes a late fee for failure to pay benefits on time, allows for electronic communications with the commissioner, and requires employers to pay for translation services if necessary. The bill will take effect July 1, 2025.

  • New York WBC Provides Guidance Regarding Submitting Employee Claim Forms
    The New York Workers’ Compensation Board (WCB) has announced that the Employee Claim (Form C-3) is now eligible for eCase document upload. The document upload feature is not a means to submit claim documents for processing. Once a hearing has concluded, documents can only be filed with the WCB via email or regular mail.

  • Louisiana State Law Institute Directed to Review Governmental Claims Act
    On June 2, 2025, the Louisiana Legislature adopted Senate Resolution 158 to authorize and direct the Louisiana State Law Institute to study and recommend legislation to revise the Louisiana Governmental Claims Act which has not been comprehensively reviewed for many years. The Louisiana State Law Institute should report its findings to the legislature by March 1, 2026 as well as to the David R. Poynter Legislative Research Library.

  • Louisiana State Law Institute Directed to Review Products Liability Expansion
    On June 3, 2025, the Louisiana Legislature adopted Senate Resolution 163 to request the Louisiana State Law Institute to study and make recommendations to lawmakers on expanding the application of the Louisiana Products Liability Act to digital products. The Louisiana State Law Institute should report its findings and recommendations to lawmakers by February 1, 2026.

  • Louisiana Authorizes Study on Financial Transactions Between Insurers, Affiliates
    On June 2, 2025, the Louisiana Legislature adopted Senate Resolution 159 to authorize and direct the Louisiana Legislative Auditor, along with the Louisiana Department of Insurance, to study and report on the financial transactions between foreign and domestic insurers writing coverage for residential property and private passenger auto insurance and affiliated entities, such as managing general agents, holding companies, and service providers, from January 1, 2021 to December 31, 2024. The report is due to the Senate by September 1, 2026.

  • Louisiana Urges DOI to Review Proper Claims Reporting Practices
    On June 2, 2025, the Louisiana Legislature adopted Senate Resolution 161, which requests the Louisiana Department of Insurance (DOI) to ensure that Louisiana residents are not being included in claims information exchanges, such as the LexisNexis Comprehensive Loss Underwriting Exchange (C.L.U.E.), when asking a coverage question or reporting a loss – without filing a claim which requires a demand for payment under the terms of an automobile, property, casualty, or liability insurance policy.

  • Oklahoma Increases Certain Claim Limits Against Government Entities
    Oklahoma Senate Bill 1168 increases the liability limits for certain tort claims against government entities under the Government Tort Claims Act. The law provides for an adjustment of the liability limits beginning January 1, 2031, and every five years for inflation. S-1168 was approved by the governor on May 27, 2028 and becomes effective on November 1, 2025.

  • Texas Expands Anti-indemnity Provisions to Land Surveyors
    Texas Senate Bill 687 extends anti-indemnity protections to land surveyors alongside architects and engineers. S-687 was approved by the governor on May 30, 2025 and becomes effective on September 1, 2025. The law applies to construction contracts entered into on or after the effective date.

  • Oregon Enacts SB-85, Wildfire Risk Reduction
    Oregon has enacted Senate Bill 85, which requires the Department of Consumer and Business Services ("DCBS") and the Department of the State Fire Marshal, in collaboration with the Department of Forestry and insurance industry representatives, to evaluate and develop community-based wildfire risk mitigation strategies to reduce wildfire risks and improve insurance affordability in Oregon. The law was approved by the governor on May 28, 2025, declares an emergency, and became effective upon enactment.

  • Oregon Enacts HB-2799, Addresses Limits on Reimbursable Attorney Fees
    Oregon has enacted HB-2799, which increases the $1,500 the limit on reimbursable attorney fees that an insurer or self-insured employer must pay if a claimant prevails against the denial of a workers’ compensation claim to $3,500. The law was approved by the governor on May 27, 2025, and becomes effective January 1, 2026.

  • Colorado Establishes Prescribed Fire Claims Fund and Prescribed Burning Program
    On May 29, 2025, Colorado enacted Senate Bill 7, which establishes both the Prescribed Fire Claims Cash Fund and the Prescribed Burning Program. The fund provides limited financial compensation for certified damages and suppression costs resulting from state-certified prescribed burns, subject to specific eligibility requirements and annual legislative appropriation. The program sets standards for the training and certification of individuals authorized to conduct prescribed burns, ensuring compliance with state laws and safety protocols. The bill was effective upon the governor's signature on May 29, 2025.

  • Oklahoma Enacts Expedited Actions Law
    Oklahoma Senate Bill 453 enacts the Oklahoma Expedited Actions Act. This Act allows a claimant, other than a counter-claimant, to use an expedited actions process provided the claimant is seeking $250,000 or less, excluding interest, statutory or punitive damages and penalties, and attorney fees and costs. S-453 also increases the non-economic damages cap for bodily injury actions from $350,000 to $500,000, with exceptions providing no caps for more severe physical injuries or $1 million for permanent mental injuries. S-453 was approved by the governor on May 28, 2025 and becomes effective on September 1, 2025.

    Minnesota has enacted House File 2432, which incorporates the Commerce Fraud Bureau into the Bureau of Criminal Apprehension and provides for the operation of the Financial Crimes and Fraud Section. The bill was signed by the Governor on May 23, 2025, and is effective May 24, 2025, except as otherwise indicated.

  • Oklahoma Prohibits Certain Assignment Agreements
    Oklahoma House Bill 1084 prohibits the assignment of post-loss insurance benefits for property damage under an auto collision or comprehensive policy, residential property insurance policy, or commercial property insurance policy. Persons who execute such agreements will be found to be in violation of the unfair or deceptive trade practice law. H-1084 becomes effective on November 1, 2025.

    Oklahoma House Bill 2263 prohibits the Oklahoma Department of Public Safety from recording or assessing points against a driver's traffic record for illegally using an electronic communication device or a hand-held cellular phone while driving. H-2263 becomes effective on November 1, 2025.

  • Texas Requires Financial Disclosures in Defense Contractor Lawsuits
    Texas House Bill 2884 requires a claimant in a civil action involving defense contractor activities to disclose the identity of financial funds received from an individual or a government affiliated with a sanctioned or embargoed nation. The claimant must disclose this information to the court under oath as part of the claimant's initial disclosures and within 10 days of receipt or identification of the funds. The law provides sanctions for nondisclosure.   • Oklahoma Expands Definition of 'Public Nuisance'
    Oklahoma House Bill 2622 expands the definition of "public nuisance" under OK ST T. 50 s 21 to include repeated acts on real property or a structure, such as unlawful drug distribution, prostitution, or human and/or sex trafficking. H-2622 becomes effective on November 1, 2025.

  • Connecticut Amends Various Worker’s Compensation Statutes
    On May 20, 2025, the governor of Connecticut signed HB 6863. The bill allows injured employees who reached maximum medical improvement to receive total incapacity benefits, updates the list of delineated body parts, allows death benefits to go the deceased employee's parents when there are no dependents and limits supplemental benefits. All the relevant sections took effect May 20, 2025.

  • Oklahoma Requires Listing of CIB on Insurance Certificate
    Oklahoma House Bill 1628 amends the Roofing Contractor Registration Act by establishing a regulatory framework for the Oklahoma Construction Industries Board (CIB) to administer and enforce residential roofing endorsement requirements akin to commercial roofing endorsement requirements. In addition, the law requires a roofing contractor's certificate of liability insurance to list the CIB as a certificate holder. H-1628 becomes effective on July 1, 2026.

  • New Jersey Proposes Codifying ABC Test for Worker Classification
    The New Jersey Department of Labor and Workforce Development (Department) has proposed creating N.J.A.C. 12:11 to formalize its interpretation of the statutory ABC test. Under this new rule, the putative employer would bear the burden of proving that both the services in question and the individual preforming them satisfy all three prongs of the ABC test. Additionally, the rule would define the key factors the putative employer must consider in determining whether a worker qualifies as an independent contractor under the ABC test. ***UPDATE: The Department has extended the comment deadline. APCIA will now be collecting member comments until June 18, 2025.***

  • Nebraska Enacts Community Development Assistance Act
    On May 6, 2026, Nebraska enacted Legislative Bill 650, which established the Community Development Assistance Act. This act provides tax credits for businesses, including insurers and individuals, for contributions to certified programs of community betterment organizations. The purpose of these tax credits is to encourage contributions from businesses and individuals that support community assistance and services, aiding in the state's efforts to address economic distress. The Act took effect on May 7, 2025.

  • Oklahoma Amends Guaranty Act
    Oklahoma House Bill 1160 amends provisions in the Oklahoma Property and Casualty Insurance Guaranty Act, including clarifying procedures for the handling of cybersecurity insurance claims. The law sets $300,000 as the maximum payout for a single-event cybersecurity insurance claim. H-1160 became law without the governor's approval on May 28, 2025 and takes effect on November 1, 2025.

  • Oklahoma Mandates Attorney General Notice After Security Breach
    Oklahoma Senate Bill 626 amends the Security Breach Notification Act by requiring individuals or businesses to notify the Oklahoma Attorney General of a security breach within 60 days after notifying impacted residents, unless exempted. S-626 also reduces or eliminates civil penalties under the Act. S-626 became law without the governor's approval on May 28, 2025 and takes effect on January 1, 2026.
